Arrest court hearings are harmful proceedings that deprive a person’s freedom and basic rights. Each person can be arrested, either in a pre- trial arrest during the police investigation, that can last up to 30 days, or either in a post indictment arrest which can last months or years until the end of the criminal trial. The presumption of innocence states that each defendant is considered innocent before proven guilty, therefore there is no justification to remain in police custody.
One can get release with bail even being charged with serious felonies.
