Parole boards & motions
Every person incarcerated in prison is eligible for parole, meaning early release after serving two thirds of the prison term, due to good conduct. De facto, only a small number of prisoners in Israel gets parole, due to the state objection to early release from different reasons: danger to society, nature of the felony, not paying the criminal compensation to victims, avoiding treatment and rehabilitation, negative police information, objection by the family battery committee and more, such as being denied to an out of prison rehabilitation program by the Prisoners’ Rehabilitation Authority.
The Parole Board decision can be appealed to the District Court, that hears the appeals by a three judges panel. Also, the court decision can be appealed in special cases to the Supreme Court, although this second appeal is rarely allowed. Serving a full term in prison is extremely hard, therefore the importance of early release back to life and freedom. This can be achieved with professional representation be an attorney that specializes in Parole Boards and knows how to deal with the system and obtain early release.
Serving time in custody is complex and challenging, especially to first time offenders. The Israeli Prison Code states the prisoners’ rights, such as vacations from custody, family visits, academic studies and proper medical care. In reality, there is an ongoing decline in prisoners’ rights, depriving them from basic rights.
Every prisoner is entitled to file a motion to District Court, that usually has regular hearing days for the motions, in a court room close to the prison. It is highly recommended to have professional legal representation by an attorney that expertises in the Prison’s Code and regulations, who can defend the prisoners’ rights in an effective manner. Among Weisbuch Law Firm precedents:
* District Court accepted a motion to allow vacation to a sexual offender prisoner.
** District Court strikes a prisoners’ “family battery profile”, thus allowing vacation.
